What are the steps to take when you are a victim of a car accident?

Stay safe

Be aware of your personal safety and others at the accident scene first
Stay in your car if there is a risk of injury or if moving might put you at risk of further injury
If there are any injuries or property damage, call 911 immediately
Move to a safe location if your car is creating a safety hazard or obstructing traffic
Do not leave the scene of the accident!

Emotions may run high after having a car accident. However, it is important to remain calm and document the accident. Be careful what you say: don’t admit fault. An investigation may later show you were not responsible.

Exchange information

Take good notes and get the following information:

Name, addresses and phone numbers of all drivers and passengers involved in the accident
Car license number, make and model of each car involved in the accident
Vehicle operator’s driver license number, insurance company and policy number
Names and addresses of as many witnesses as possible
Names and badge numbers of police officers

Protect Your Identity!

DO NOT allow your license or registration to be photographed.

Document damage

Take photos of the accident scene and vehicle damage. Record the details of the accident while they are fresh in your memory. If possible draw a diagram to recreate the scene.

File a police report

Even if no one is hurt from the accident, you should always contact the police and file an accident report. You might need it when you file a claim.

Do you recover more than your clients?

NO, we do not recover more than our clients in pre-litigation cases. If for any reason our attorney’s fees under our agreement exceed our client’s recovery, we will reduce our attorney’s fees in order that we do not recover more in attorney’s fees than our client does.

What is the process for a personal injury case?

The process varies with the nature of each case. For example, the process for a motor vehicle accident case is different from a slip and fall or a dog bite accident case. At the same time, the procedure can be different depending on whether the defendant has insurance.

However, the initial steps include setting up the claim, making sure that our clients receive the medical treatment needed. We help clients resolve property damage claims at no extra charge. After client completes medical treatment, a demand package is prepared and sent to insurance company of the responsible party. Once this occurs, the negotiation process begins until a settlement is reached. If the negotiation is not satisfactory, we will discuss the possibility of filing a lawsuit against the responsible party (ies).

What is the likelihood that my case will settle or likely to go to trial?

The majority of personal injury cases settle without having to go to court. Only a small percentage of cases go to trial, most are resolved before a trial occurs. The likelihood of going to trial depends on the facts and issues of each individual case. There is a greater likelihood of a case going to trial if liability is disputed or when injuries and damages are more significant.

Do I need an attorney to handle my personal injury case or can I handle it on my own?

Handling a personal injury case is complicated, and it is not recommendable for individuals to handle their case on their own. No matter who you chose to represent you, we recommend that you hire an experienced and honest personal injury attorney to help you with your personal injury case.

Handling your case yourself does not mean you will end with more money in your pocket.
